The UK’s unfair dismissal reforms are set to reshape executive exits, increasing both legal and commercial considerations for sponsors and their portfolio companies. Here’s what you need to know: ➡️ Uncapped compensation is coming. From January 2027, successful unfair dismissal claims will no longer be subject to the current compensation cap. ➡️ More employees will be eligible to claim. White & Case secured a significant victory for Orbia's Vestolit business: The Amsterdam District Court dismissed two antitrust damages claims exceeding €1 billion, brought by petrochemical sellers Shell Chemical and Repsol. The claims arose from allegations that discussions involving an ethylene pricing index (the MCP) had artificially lowered ethylene prices. Following examination of contemporaneous documents, data, and extensive expert economic evidence, paired with innovative cross-border discovery, the Dutch Court found that the claimants failed to demonstrate that Orbia's conduct had any plausible effect on the market. The Dutch Court’s detailed analyses spanned 55 pages in the Shell proceeding, and 36 pages in the Repsol proceeding. The outcome reflects White & Case's ability to combine sophisticated antitrust advocacy and seamless cross-border coordination to defend clients in high-stakes competition disputes.
