FinCEN’s proposed rules for Anti-Money Laundering Whistleblower Improvement Act (AML WIA) must address the right of whistleblowers to submit original information directly, confidentially and anonymously, to the DOJ. The DOJ is required to accept confidential AML WIA complaints. Per the statute, the whistleblowers must be explicitly guaranteed full confidentiality and anonymity within the Department of the Treasury and throughout the award application process. Currently, the proposed regulation does not guarantee protection. Join NWC in urging FinCEN to revise the rules to protect whistleblowers' right to directly submit original information to the DOJ. An urgent message to whistleblower and anti-corruption advocates! FinCEN’s proposed rules for implementing the Anti-Money Laundering Whistleblower Improvement Act (AML WIA) have serious gaps that will pose challenges for whistleblowers around the world. In our comments submitted to FinCEN we highlight various problems: - Strict, non-statutory filing requirements that will disqualify countless whistleblowers who Congress intended to be eligible for awards, - A failure to acknowledge and protect international whistleblowers, who provide the U.S. with critical whistleblower tips at great risk to their lives, and - Weakened confidentiality requirements, which are inconsistent with the statutory requirements and put whistleblowers at risk. FinCEN must address these problems to ensure that the AML WIA properly protects whistleblowers, increases in enforcement, and targets financial networks that facilitate crime.
