Sports Data Labs is proud to announce the issuance of U.S. Patent No. 12,696,878 covering our foundational AI-based consent management system for personal data – including Name, Image, & Likeness (NIL) – across sports, fitness, human performance, and related contexts in the US. The patented system and method puts the individual in control of their personal data and NIL: they — or their authorized representative (e.g., lawyer, agent, organization, AI program) — set the terms governing their data, including who may access it, for what purpose, in what geography, on what exclusivity basis, and/or for what consideration. The patented architecture is configured to either allow the individual or their representative to select consent terms or leverage AI to infer the terms an individual is likely to want, generate data-use rules automatically, and present them back for review prior to taking effect. Our patent issuance comes at a time when: (i) regulators in the US and worldwide — from the EU Data and AI Acts to Washington's My Health My Data Act and the UK Data Use and Access Act — are making auditable, individually-controlled consent a requirement rather than a feature; (ii) consented personal data, at scale, is the defining input required for AI systems today to help us live longer & healthier lives; and (iii) NIL programs are being built across collegiate and professional sports with a consent and rights layer that remains fragmented. Our patented architecture provides a standardized way for individuals at scale to create, modify, and enforce terms for use of their data and NIL, while supporting organizations in navigating the complexities and opportunities tied to its collection, processing, and use. Our leadership joined the National Basketball Players Association (NBPA) at their PLYRS Performance Summit last week at The Sanctuary in Spain, alongside our partners at Cleveland Clinic. The Summit convened athletes and leaders across sport, performance, health, and technology. This year's conversation spanned athlete-owned data, biomechanics, recovery, regenerative medicine, AI, and biological performance. As part of their newly announced collaboration, Cleveland Clinic and the NBPA are forming a committee with Sports Data Labs to assess opportunities to advance innovation in athlete health data and sports performance, as well as athlete-owned data infrastructure, technology platforms, and predictive performance insights. It was a privilege to attend this year's National Basketball Players Association (NBPA) PLYRS Performance Summit at The Sanctuary in Málaga, Spain, and to represent Cleveland Clinic with my colleagues as the presenting partner. A sincere thank you to the NBPA for bringing together an exceptional group of athletes, clinicians, researchers, technologists, and innovators who share a common goal: helping athletes perform at their highest level while supporting their long-term health. One of my biggest takeaways was that the future of elite performance isn't defined by any single technology or intervention—it's built through collaboration. The conversations around athlete-owned data, biomechanics, recovery, regenerative medicine, AI, and human performance all reinforced the importance of combining science, medicine, and trusted partnerships to empower athletes with better insights and better outcomes. The summit also marked an exciting milestone as Cleveland Clinic and the NBPA announced a new partnership focused on advancing athlete performance and innovation. Together with the Cleveland Clinic Global Peak Performance Center and Sports Data Labs, we're building on a shared vision to responsibly leverage athlete data, accelerate research, and create new opportunities to improve performance, health, and longevity—always with the athlete at the center. The industry's biggest voices are converging on data. First, Alex Karp (Palantir Technologies) argued that owning your data, your models, and what you learn from them beats renting intelligence, with Palantir and NVIDIA partnering to build exactly that. Now Microsoft’s Satya Nadella — in the post below — says sharing data with AI requires "something akin to patents": a way to disclose without surrendering. Major enterprises are coming together on a central theme: not that data is valuable (obvious), but that value isn't flowing back to the people who create it, and control/ownership is the fix. And it doesn't stop at the enterprise. If a company's prompts and corrections are valuable exhaust, what is a human's continuous biological data record — the heartbeat, the sleep, the labs, the genome? The most valuable data on earth, currently flowing one way. I published this thesis in Forbes in January 2021: that personal data would become an asset class — owned, controlled, and monetized by the people who create it — and that the Human Data Economy would run on data agents and consent-brokering platforms. We had a clear view on where the future was headed when we started Sports Data Labs and our patent portfolio – which dates back to 2019 – anticipated this reality: machine-enforceable consent that travels with the data, terms the data creator sets, value that flows back to them. The principle now has Palantir, Nvidia, and Microsoft behind it. The infrastructure — for the individual — is what we've been building at SDL. Now the industry is catching up. The summit brought together the global players association ecosystem — including FIFPRO, National Basketball Players Association (NBPA), NHLPA, Major League Baseball Players Association, World Cricketers' Association (WCA), WNBPA (Women’s National Basketball Players Association), Rugby League Players Association (RLPA), AFL Players' Association, The Professional Women's Hockey League Players Association, EuroLeague Players Association (ELPA), and other leading organizations — for conversations shaping the future of global sport. Mark spoke on multiple panels alongside Julia Powles (University of California, Los Angeles - School of Law), Jonas Baer-Hoffmann (OneTeam Partners), Ahmad Nassar (Winners Alliance), and Matthew Graham (WPA), on topics related to the Player Data Economy and the associated legal and commercial frameworks tied to the collection, consent, processing, and monetization of personal data in sports. Sports Data Labs has signed a term sheet with the World Cricketers' Association (WCA) — the global representative body for professional cricketers across 17 countries — to establish a player-led framework to support the collection, protection, and commercialization of athlete data for professional cricketers globally. Under the framework, our platform — including our AI-based digital data/IP representative & lifetime companion for health, performance, longevity, and commercialization developed in collaboration with Cleveland Clinic — will provide players with a centralized, consent-managed system for their performance, medical, and other personal data, bringing together inputs from wearables, EMR systems, and other team, league, and third-party sources.
